Email Compliance
This document describes LogiqLead's compliance with email sending regulations and the requirements we impose on users of the platform.
1. CAN-SPAM Act (United States)
1.1 Our Compliance
LogiqLead provides tools that help you comply with the CAN-SPAM Act:
- Automatic unsubscribe link insertion in all emails
- Suppression list management
- Opt-out tracking and enforcement
- Sender identification tools
1.2 Your Obligations
As a user of LogiqLead, you must:
- Include your valid physical mailing address in all emails
- Provide a clear and conspicuous unsubscribe mechanism
- Honor opt-out requests within 24 hours (we automate this)
- Use accurate sender information and subject lines
- Not use deceptive headers, "From" names, or subject lines
- Not send emails to addresses obtained through harvesting or purchased lists
1.3 Penalties
CAN-SPAM violations can result in penalties of up to $50,120 per email. We reserve the right to suspend accounts that violate CAN-SPAM.
2. GDPR (European Union)
2.1 Consent Requirements
For recipients in the EU/EEA, you must have a valid legal basis for sending emails:
- Consent: Recipient has explicitly opted in to receive emails
- Existing relationship: Recipient has a current business relationship with you
- Legitimate interest: You have a documented legitimate interest (with proper assessment)
2.2 Required Elements
All emails to EU/EEA recipients must include:
- Clear identification of the sender
- A valid unsubscribe mechanism
- Your physical address
- Reference to the legal basis for sending (if not consent)

3. CASL (Canada)
3.1 Consent Requirements
CASL requires express or implied consent before sending commercial electronic messages (CEMs):
- Express consent: Recipient has explicitly agreed (opt-in)
- Implied consent: Based on an existing business relationship (up to 2 years) or conspicuous publication (up to 6 months)
3.2 Required Elements
All emails to Canadian recipients must include:
- Sender identification
- Contact information (mailing address and at least one of: phone, email, web address)
- A clear and functioning unsubscribe mechanism

4. Digital Personal Data Protection Act, 2023 (India)
4.1 Consent Requirements
Under the DPDP Act, you must have valid consent before sending commercial communications:
- Consent must be freely given, specific, informed, and unambiguous
- Consent must be obtained through a clear affirmative action
- Recipients must be able to withdraw consent at any time
4.2 Required Elements
All commercial communications must include:
- Clear identification of the sender
- A mechanism to withdraw consent or unsubscribe
- Contact information for the sender

5. Best Practices
5.1 Email Authentication
We recommend and support email authentication standards:
- SPF (Sender Policy Framework): Authorizes servers to send email on your behalf
- DKIM (DomainKeys Identified Mail): Cryptographically signs emails
- DMARC (Domain-based Message Authentication): Sets policy for handling failed authentication
5.2 List Hygiene
- Regularly clean your email lists
- Remove bounced addresses promptly
- Honor unsubscribe requests immediately
- Use double opt-in for new subscribers
- Monitor spam complaint rates
5.3 Content Quality
- Use clear, accurate subject lines
- Provide valuable, relevant content
- Avoid spam trigger words and phrases
- Maintain a healthy text-to-image ratio
- Include a plain text version of HTML emails
6. Monitoring and Enforcement
6.1 Our Monitoring
We monitor:
- Bounce rates (hard and soft)
- Spam complaint rates
- Unsubscribe rates
- Sending patterns and volume
6.2 Thresholds
Accounts may be suspended if:
- Hard bounce rate exceeds 5%
- Spam complaint rate exceeds 0.1%
- Unsubscribe rate exceeds 2%
- Sending patterns indicate spam or abusive behavior
6.3 Enforcement Actions
- Warning notification
- Temporary sending restrictions
- Account suspension
- Account termination
- Reporting to relevant authorities (where required by law)
7. Suppression Lists
7.1 Global Suppression
LogiqLead maintains global suppression lists to prevent emails from being sent to:
- Addresses that have unsubscribed across the platform
- Known spam traps
- Invalid or permanently bounced addresses
7.2 Account-Level Suppression
Users may maintain their own suppression lists at the account level. These lists are respected across all sequences and campaigns within the account.
7.3 Suppression List Management
- Suppression lists are applied before every email send
- Addresses on suppression lists cannot be re-added without fresh consent
- Suppression data is retained indefinitely to prevent future sends
